4.15.7 Beginning and Ending Dates for Appointment of Classified Employees

A. Purpose

The purpose of this policy is to define the appropriate beginning and ending dates for classified appointments.

This policy requires appropriate breaks in service or continued employment according to assigned appointment dates.


  1. The effective beginning date for the appointment of new classified staff shall normally be the first day of work, but under one of the following conditions the beginning date may be a holiday, Saturday, or Sunday.
    1. Appointment is necessary to maintain continuous employment with the State of Texas as a direct transfer from another state agency.
    2. Appointment is to a position which requires the new employee actually to begin work on a holiday, Saturday, or Sunday.
    3. Appointment is to a monthly salaried position which is effective on the first day of a calendar month provided that the appointment requires performance by the employee of all customary duties of the job for all of the official working days of the month in which the employment is to begin.
  2. Appointments will normally carry an ending date effective on or before August 31 of the fiscal year in which the appointment is being made. All appointments of classified employees will be made on an annual basis, in writing, and subject to the Regents Rules and Regulations. Appointments made from grants or contracts may terminate in accordance with the terms thereof. The following special provisions apply:
    1. The ending date of an appointment or the date on which an appointment is terminated may include a holiday, Saturday, or Sunday which immediately follows the last day of work, except when the holiday, Saturday, or Sunday is the first day of a new calendar month.
    2. A separating employee may, with the agreement of the institution, be allowed to remain on the payroll after the last day worked to utilize vacation leave time in lieu of being paid a lump sum.
  3. The following conditions will not constitute a break in an individual’s continuity of employment:
    1. termination followed, without loss of payroll time, by immediate reappointment;
    2. termination to enter military service followed by reappointment within 90 days after honorable discharge or release from military service;
    3. transfer of employee, without loss of payroll time, within The University of Texas System or from another state agency; or d. leave without pay.
  4. The following conditions will constitute a break in an individual’s continuity of service:
    1. termination followed by a loss of payroll time before reappointment with any component institution of The University of Texas System, state institute of higher education, or other state agency; or
    2. termination to enter military service and failure to be reappointed within 90 days of honorable discharge or release from military service.

F. Review

This policy shall be reviewed by Human Resources every five years or as legislation changes.
