4.15.9 Employment of Minors

A. Purpose

To ensure that UT Tyler follows the provisions of the Fair Standards Act of 1938.

Persons affected: All minors ages 14 to 18 years of age employed at UT Tyler.

D. Policy and Procedures

The child labor provisions of the Fair Labor Standards Act of 1938, as amended, apply to The University of Texas at Tyler and are to be strictly adhered to by departments when considering minors for employment.

  1. The minimum employment age for minors in nonagricultural occupations declared hazardous by the Secretary of Labor is 18 years.
  2. Minors who are 16 and 17 years of age may be employed in any occupation other than a nonagricultural occupation declared hazardous by the Secretary of Labor.
  3. Minors 14 and 15 years of age may be employed outside school hours in certain occupations and in certain conditions which do not interfere with their school, health, or well-being.
  4. Information regarding specific regulations, hazardous occupations, and/or exemptions may be found in Department of Labor, Wage and Hour Publication 1330, “Child Labor Requirements in Nonagricultural Occupations.”
  5. In the case of willful violation of the child labor provisions, a fine up to $10,000 or imprisonment, or both may be assessed.

This policy shall be reviewed by Human Resources every five years or as legislation changes.
